Many injured workers’ become frustrated with their discussions and disputes, with the WSIB.
For the most part, the WSIB is a very bureaucratic administrative government agency. The decision-making process may be slow and inconsistent. Furthermore, workers’ are sometimes perceived by the WSIB, as cheating the system.
As examples of the above, the Ontario Court of Justice REGINA V. – acquitted a worker, of the Board’s charges of fraud and failure to report a material change.
Worship Michael Kitlar made some observations with respect to the Board’s adjudication.
“The information provides to the Court that Mr. R. is the general manager of ----, and therefore, has provided a false statement to the Board. And by doing so willfully fails to inform the Board of that said material change. The information comes before the Board by way of his employer, ---- in regard to a Workplace Safety and Insurance Board investigation.”

“Now, the worker’s from ---, the only thing I can really say about that evidence, is self- serving.”

“Mr. - upon a conviction could be affected for the rest of his life under the W.S.I.B. and it’s very wide found.”

“And the policies and procedures that are in place are so non-specific it makes it difficult to adjudicate over matters. And something should really be, as you indicated in your submissions, something should really be done to make it a situation where it’s clear, exactly what’s going on. Because rather than being objective you can be subjective and objective at the same times depending on what day of the week it is the adjudicator can make the decision such as the Court is making a decision and the ramifications are just so wide spread.”
