I say this because, the WSIB may deny a claim based on lack of continuity of treatment and/or complaint.

Maintain your time limit to appeal any decisions.

I say this because, since January 1998, the WSIB has imposed strict time limits. If you do not maintain your time limit to appeal any decisions then you may run the risk of losing your right to appeal, if something goes wrong at a later date.

Be cooperative with your accident employer.

I say this because, irrespective of the consequences of your injuries, the WSIB may side with an employer who will most often say that suitable employment was offered to a worker at no wage loss.

I say this because, the WSIB regularly reduces a worker’s compensation rate (earnings basis) because of various factors such as seasonal employment, student, minor (under the age of 21) etc. This may negatively affect your WSIB benefits and services.

Get the Labour Market Re-entry Plan (LMRP) right, the first time.

I say this because, the WSIB will typically offer only one LMR plan.

I say this because, an astute worker representative may be able to secure a significant amount of past, present and future benefits that may have been overlooked.

I say this because, many WSIB worker disputes are caused by questionable interpretation of WSIB policies and legislation. Have a representative communicate on your behalf, at all times. This may easily be done via teleconference calls. A knowledgeable worker representative retained to act on your behalf should at all times, have your best interests in mind.
